On Sept. 30, a summary judgment was awarded to Bull Moose Tube Co.(BMT) in their lawsuit against the City of Gerald. The lawsuit, filed in February 2018, stemmed from the city’s attempts to raise the monetary terms of their lease with BMT.
The city filed an appeal in the Eastern Court of Appeals on Nov. 5.
A motion for extended time to file brief was entered on behalf of the city by Magaret Claire Eveker Jan. 24. Three days later the request was granted until April 3. Since then, an additional three such requests have been asked for and granted.
The latest, filed by David A. Streubel, gave the city until Sept. 1 to file the brief.
Eveker and Streubel are both with Cunninham, Vogel & Rost, P.C., the firm that provides legal services to the City of Gerald.
Last Thursday, July 23, the Board of Aldermen met with only an executive session on their agenda. The subject of the closed meeting was to discuss legal actions, causes of action, or litigation involving a public governmental body and any confidential or privileged communications between a public governmental body or its representatives and its attorney.
Struebel was in attendance as were all four aldermen and the mayor.
