James Flannery, Gerald, was sentenced to one year and one day of imprisonment for each of three counts to which he pled guilty. The sentences will run concurrently according to the Honorable Ronnie L. White, U. S. District Judge.
The sentence was filed Nov. 13.
Flannery pled guilty to wire fraud, misuse of social security number and theft of government funds Aug. 1.
In addition to the prison time, Flannery was also ordered to pay an assessment of $300, restitution of $113,046.10, and a fine of $5,500.
It was noted that the interest requirement would be waived for the restitution payments.
Flannery was also ordered to cooperate in the collection of DNA.
It was recommended that Flannery be housed at a facility as close as possible to Gerald. He will be notified by the U.S. Marshal as to when and where he will report to a federal prison facility.
Once released from prison, Flannery will be on supervised release for three years on each count. That condition will also run concurrently.
The second of the four original counts against Flannery was dismissed by motion of the U. S. Prosecutor.
That count alleged Flannery “made false, fictitious and fraudulent statement and representation” of facts, provided false documents. This was originally issued in reference to his documents filed in a “Continuing Disability Review Report” representing that he had not worked since his last medical disability decision.
The four charges were made by a grand jury.
