South Dakota man charged with nine counts of child pornography

The South Dakota man charged in December 2025 with statutory rape and six counts of statutory sodomy stemming from the alleged sexual contact with an underage Owensville girl is charged in a new felony complaint with nine count of possession of child pornography.

Jorge Cuenca, who remains in custody in Franklin County on a $100,000 cash-only bond since his arrest and extradition from Kansas in late 2025, had a new cash-only bond set at $100,000 on the nine new charges. According to charging documents issued June 26 by Gasconade County Associate Circuit Court Judge Ada Brehe-Krueger, Cuenca is alleged in a felony warrant to have been in possession of sexually explicit still images and video images of the teenage victim.

The charges stem from images retrieved from Cuenca’s Snapchat account and include data from Nov. 30, and Dec. 1 and 3, 2025.

Following up on the initial investigation in early 2026, Owensville Police obtained a warrant for Cuenca’s Snapchat account on Jan. 23 and received the information sought from the social media outlet on Feb. 16.

According to the probable cause statement filed as the application for the new charges, Cuenca is alleged to have sent the minor child images of himself on Nov. 25, 2025, and on Nov. 30 she replied with images of herself. The images were described in charging documents as “obscene and  sexually explicit in nature.” These images, police noted, were saved on Cuenca’s Snapchat account.

Since the original charges were filed, Cuenca on April 22 waived his formal arraignment and a not guilty plea was entered. He was also granted a change of judge from Presiding Circuit Judge Craig E. Hellmann to Circuit Judge Ryan J. Helfich. A scheduled June 11 hearing was continued   by both parties until 9 a.m. Monday, Sept. 21, in Hermann.

On the new charges filed June 26, Cuenca was scheduled for a bond review and status hearing Tuesday morning before Brehe-Krueger. He was arraigned June 30 and a not guilty plea was entered on his behalf. Cuenca appeared before Brehe-Krueger in custody from Franklin County via a telephone link.

Police alleged Cuenca and the young girl had been in communication with each other via Snapchat for a month and a half before he visited town from his residence in Sioux Fall, South Dakota.
