Tyler Chris Schmidt of Gerald was picked up on a warrant Saturday for failure to appear in court on felony charges related to a single-vehicle collision that claimed the lives of two area men this fall near the Landwehr Subdivision south of Owensville
He also faces with two additional warrants issued for failure to appear in Osage and Maries county courts.
Schmidt was charged Aug. 24 in Gasconade County with two driving while intoxicated (DWI) charges: a class B felony for DWI resulting in the death of two or more persons and a Class D felony for DWI resulting in serious physical injury.
According to a report by the Missouri State Highway Patrol (MSHP), shortly after 9 p.m., a 2007 Jeep Liberty driven by Schmidt traveled off the right side of the roadway, struck three mailboxes, a utility pole and a driveway embankment before becoming airborne, striking the ground, overturning and ejecting all occupants from the vehicle then coming to a rest on its wheels.
Pronounced dead at the scene due to blunt force trauma to the head was Bryan Hodges, 17, of Bland. His father, Jerry Hodges, Jr., 37, of Bland, and Schmidt were listed as “seriously injured” and transported via ambulance to Mercy Hospital of Washington. A fourth passenger, Alex Hilton, 22, of Belle, was transported by ARCH to Mercy St. Louis where he later succumbed to internal injuries.
In Osage and Maries counties, Schmidt faces class D misdemeanors of operating a vehicle without insurance.
Schmidt failed to appear at his hearing in front of Judge Ada Brehe-Krueger in Gasconade County last Wednesday after being released on a $50,000 cash or surety bond in September. A hearing was promptly scheduled for Friday and a bond forfeiture hearing set for Jan. 7. He then failed to appear at the Friday hearing. A warrant was issued and Schmidt was arrested Dec. 20, taken into custody at the Osage County Jail and later released on another $50,000 cash or surety bond.
After failing to appear in front of Judge Sonya Day Brandt in Osage County on Dec. 2, a warrant was issued the following day with bond set at $269.50 cash only. The warrant was served Monday while Schmidt was in custody and a hearing scheduled for Tuesday.
In Maries County, he failed to appear in front of Judge Kerry G. Rowden on Nov. 4 and a warrant was ordered the following day with bond set at $300 cash only.
His bond conditions include no possession or consumption of alcohol, fitting of a SCRAM ankle monitor within 24 hours of posting bond and no contact with the victims and victims’ families.
