Nathan Lee Medlock of Owensville was charged April 8 with the class D felony of second degree assault following an alleged altercation involving a firearm.
According to the probable cause statement, at approximately 1:42 p.m. on April 7, the Gasconade County Sheriff’s Office (GCSO) was dispatched to a fight in progress where the reporting party stated her husband was struck with a gun.
GCSO reports arriving on scene to find one male leaving in an ambulance and another laying on the ground with visible facial injuries and detained in handcuffs by the Owensville Police Department (OPD).
The alleged victim reported that he was walking his dogs with his wife in the cemetery when he observed Medlock outside pointing an air rifle at neighboring dogs and that he yelled at Medlock to stop. He then advised that Medlock yelled back, charged toward him with the rifle and struck him in the nose with it. The victim reportedly disarmed Medlock while he attempted to swing the rifle a second time, taking him to the ground, striking him several times and holding him there until officers arrived.
GCSO reports reading Medlock his Miranda rights and then asking what had occurred, to which he reportedly replied, “he tried to kill me,” advising that he went outside to get fresh air and to see if his air rifle worked when the victim allegedly started yelling at him.
Medlock reportedly admitted that he attempted to confront the victim and that the victim beat him up, that he did not strike the victim, but also did not recall who struck first.
Both Medlock and the victim had apparent injuries upon GCSO’s arrival with the victim reported as having swelling and bruising around his face, injuries to his nose, cuts and scrapes on his arms and blood on his shirt and Medlock with visible bruising on his face.
Medlock was transported to Mercy Washington by EMS and subsequently to Franklin County Jail.
GCSO reported requesting a warrant, stating that Medlock had a prior conviction for unlawful use of a weapon, a prior conviction for possession of a controlled substance and that earlier the same morning, he contacted law enforcement requesting to speak with a deputy and stated over the phone, “Do I need to come up there and kick your [expletive deleted]?”
Medlock was released on a $25,000 surety bond the same day (April 8) with a bond condition of no contact with the victim.
Arraignment is scheduled for April 29 at 9 a.m. with Ada Brehe-Krueger presiding in Gasconade County Division IV.
